Judge Rohan Lawrence said he was satisfied there was enough evidence to bring Brown to the Supreme Court and asked how he would base the murder charge.
Dressed in a suit, Brown cried as he entered his request.
“Blame, Your Honor,” he told the court.
He will next appear for a hearing before the Supreme Court on September 30.
Deakin University held a candlelight vigil to commemorate Cheng and all victims of domestic violence after Brown was indicted earlier this year.
The university encouraged staff and students to seek support and suspended relevant courses for a period of time.
