Taxi driver punched out by gel blaster-wielding vigilante after making false rape allegation

A taxi driver falsely accused of rape was robbed and beaten when a gel-blaster-wielding vigilante located him, a court has told.

Mark Thomas Kilminster, 41, was “triggered” when a girl told him she had just been sexually assaulted by a taxi driver.

But in fact the girl had stolen the taxi driver’s phone in an alleged fare evasion in southern Brisbane in July 2021, the district court heard on Wednesday.

The girl attacked the taxi driver and fled with the phone along with two other women without paying the fare after the taxi arrived at an address in Inala.

As she entered the address, the girl told Kilminster she had been raped by the taxi driver – prompting a group to come out of the house and throw rocks at the taxi.

The taxi driver left and lodged a complaint with the police, but shortly after leaving Inala Police Station, his taxi was followed by another car for about 10 km.

The court heard Kilminster – armed with a gel blaster – jumped into his car with an accomplice and drove around looking for the cab after one of the girls gave the number plate.

Upon spotting the taxi, Kilminster was dangerously following, driving once on the wrong side of the road and attempting to block the taxi.

When the taxi driver stopped at his father’s house, Kilminster got out of his car and brought out what the taxi driver thought was a gun and accused him of raping the girl.

Kilminster – a father of three who was on parole at the time – pointed the gel blaster at the taxi driver and told him he would shoot if he got out of the car, the court was told.

The cab driver tried to placate Kilminster by handing him $200 but was hit in the head nine times with the butt of the gel blaster before escaping.

“Vigilance must be deterred from the courts, (but) if (the girl) had told the truth, this would never have happened,” Judge Paul Smith said of the incident.

Defense attorney Dominic Nguyen said the girl’s rape allegation provoked Kilminster’s reaction because he was allegedly sexually abused in and out of juvenile detention years ago.

“Of course, there should be no condoning of his vigilantism, (but) the (rape charge) creates a significant problem for him,” Nguyen said.

Kilminster pleaded guilty to dangerous operation of a motor vehicle, threat of night violence, armed robbery combined with personal violence, false imprisonment and malicious damage.

He will be sentenced on Friday.
