The Supreme Court has blocked the Biden administration from enforcing a requirement that employees at large businesses be vaccinated against COVID-19 or tested weekly and wear masks at work.
At the same time, the court is allowing the administration to proceed with delegating vaccines to most healthcare workers in the US.
Thursday’s court order amid a spike in coronavirus cases is a mixed bag for the administration’s efforts to increase vaccination rates among Americans.
The court’s conservative majority concluded that the administration had exceeded its authority by seeking to impose the Occupational Safety and Health Administration’s vaccination or testing rule on businesses. The United States has at least 100 employees. More than 80 million people will be affected.
“OSHA has never imposed such a mandate before. So does Congress. Indeed, although Congress has enacted significant legislation addressing the COVID-19 pandemic, it has refused to enact any measure similar to what OSHA has enacted here,” the conservatives wrote. in an unsigned comment.
In dissent, the three court libertarians argued that the court itself was overdoing it by substituting its sentences for medical professionals.
“Acting beyond its jurisdiction and without legal basis, the Court supersedes the judgments of Government officials charged with responding to workplace health emergencies,” the Judges said. Judges Stephen Breyer, Elena Kagan and Sonia Sotomayor wrote in a general disagreement.
The vaccine authorization that courts will authorize nationwide includes virtually all healthcare workers in the country.
More than 208 million Americans, 62.7% of the population, are fully immunized, and more than a third of them have received booster shots, according to the federal Centers for Disease Control and Prevention. All nine judges received additional shots.
