BALTIMORE (WJZ) – Baltimore State Attorney Marilyn Mosby will face a jury in the criminal case against her on May 2.
She has long asked for a speedy trial so this can be resolved before her next election.

Prosecutors earlier said they may be ready to go by April. The final decision was made during a private meeting between the judge and attorneys Wednesday morning.
Speeds are still fast by federal standards.
“When there is a good, extenuating reason why a case should proceed quickly, which seems to be the case here with the upcoming election, I don’t think it is up to the judge to handle it. the case will try to move. it as quickly as possible,” said attorney Adam Ruther with Rosenberg, Martin, Greenberg. “Especially here, where you have the political scene, where you have the political clock ticking.”
Ruther has nothing to do with this case.

Federal prosecutors expect the jury trial to last four days. They plan to call up to 15 witnesses. Mosby’s team said in court filings they could call up to 10 witnesses if they made a plea.
Mosby’s lawyers have called federal prosecutors “enemies” and accused them of “serious misconduct” in recent court filings that brought charges against her.

They also singled out prosecutor Leo Wise and described the case as “the culmination of a protracted crusade to destroy the political career of a young, progressive, black elected official, by a prosecutor who has repeatedly financed the campaigns of her political opponents. ”
“There is no doubt that Mr. Wise will respond to these allegations, and I imagine it will be argued quite fiercely that there is nothing wrong with prosecuting him – there is nothing wrong with him pursuing case,” Ruther told WJZ. “There are no smoking guns in what she is presenting. There is no clear argument that there is a clear reason that he should be excluded in this case or that it should be removed. It tends to expand on what her defense attorney is doing in his media interviews, which is to make broad accusations of aversion or prejudice against Wise, in particular an attempt to cast a shadow over the entire prosecution. “
Mosby’s team also attacked US Attorney Erek Barron, submitting a statement from a witness claiming that Barron discussed rumors about Mosby’s sex life and then allegedly said: ” I don’t understand all the hype surrounding her. I do not understand. She’s my intern, and I don’t understand how she got to where she is. “
Barron’s office generally does not comment on ongoing litigation. He had previously told WJZ Investigator Mike Hellgren his office “will monitor the evidence it leads to.”
The absence from recent filings is a basic defense against the allegations at the heart of the case: That Mosby lied about having Covid-19-related financial problems to get illegal, penalty-free withdrawals from his retirement account through the CARES Act.
Prosecutors have also claimed she lied on mortgages for her Florida vacation homes.
“She is definitely in a unique position and that guarantees her team a unique strategy. I don’t necessarily know that it’s risky as long as there are more substantive safeguards that will be put in place at trial,” Ruther said. “If [the government] If she succeeds in gathering all these ancillary arguments about the unwarranted motives of the prosecutors being removed from the trial, then the trial will be much more candid and based on what she knows, Ms. What did she do, what did she say and how did it happen. with elements of defence. ”

- By March 11, prosecutors must submit their response to the Mosby’s Recall Motion.
- By March 25, Judge Lydia Kay Griggsby will rule on the defense moves.
- By April 4, the judge and attorney will work on the jury’s instructions and the jury selection process.
- On April 14, there will be a hearing on final motions before trial.
- On April 27, there will be a final pre-trial status meeting.
