Police have since confirmed that the man died of his injuries on Wednesday night.

The man was fatally injured when a dispute broke out between the 56-year-old man and a 25-year-old man, the son of the victim’s partner, at an address in The Pines near Millmerran, reportedly around 9.30pm.

The 25-year-old allegedly fled the scene to a nearby gas station on the Gore Highway in Captains Mountain and was taken into custody.

He was initially charged with aggravated assault, but this was dropped on Wednesday when he was formally charged with attempted murder.

Police said Thursday the charges have since been upgraded to murder (offences of domestic violence) following the victim’s death.

He was also charged with one count each of robbery (a domestic violence offense), unlawful use of a motor vehicle (a domestic violence offense) and armed presence to incite fear.

Toowoomba Police Detective Paul McCusker said the “unprovoked (alleged) attack resulted from the 25-year-old man demanding the car keys”.

“He is known to both the victim … and the son of the woman who lives with (the victim) at the address,” he said Thursday.

Police believe a sword was used in the attack, McCusker added.

McCusker said the alleged attacker’s mother was at the home at the time but unharmed.

She ran to a neighbor’s house for help and they called the police.

“She’s walking as best she can, obviously a very traumatic event. She supported us throughout the investigation,” McCusker said.

An autopsy will be carried out in the coming days.

The 25-year-old is due to appear again in Toowoomba Magistrates’ Court on Thursday.
