Judge denies Mosby’s defense requests to drop case and remove prosecutor – CBS Baltimore

BALTIMORE (WJZ) — A federal judge ruled Thursday against all three motions by Baltimore District Attorney Marilyn Mosby’s defense, including motions to dismiss her charges and remove a particular prosecutor from the case.
A grand jury indicted Mosby in January on four felonies, including charges of perjury and false testimony. Federal prosecutors allege she lied about suffering COVID-19 hardships to withdraw money from her retirement account without penalty and falsified information on Florida vacation home loan applications.

Mosby’s attorneys allege that Assistant US Attorney Leo Wise and US Attorney for Maryland Erek Barron both have prejudices against Mosby. Her defense moved that Wise – who had donated to Mosby’s top challenger in the 2018 election cycle – be removed from the case.
“If it were a storybook, it would be called ‘Selective and Vindictive Prosecution,’ and the author of that storybook would be that [United States] government in this case,” Mosby’s attorney, A. Scott Bolden, said at a filing hearing Thursday.

Wise replied that he had not influenced the prosecution in any way.
“On one point I agree with Mr. Bolden that he told a story…I’m the line district attorney,” he said. “I’m one of three in this case. I work for the federal government. I could no more choose to prosecute someone than I could authorize airstrikes in Russia.”

In addition to seeking Wise’s impeachment, Mosby’s defense asked prosecutors for a “particulars list” detailing how Mosby lied about mortgage applications and withdrawing money from her retirement account, among other things. The request was rejected.

Mosby also this week announced her re-election bid to remain Baltimore’s top attorney. She officially ran for re-election on Thursday.
