A federal grand jury found a Texas man on all five counts in the first trial of nearly 800 people charged during the January 6 siege of the U.S. Capitol.

Reffitt’s attorney, William Welchreported urge the jury to question the authenticity of the government exhibit.

But in a video submitted as evidence at the trial, Reffitt himself appears to admit to having a gun at the time.

In a recorded video call, Reffitt is detailing what happened on the steps of the Capitol. He was very detailed, and he seemed to believe that his being sprayed with chemicals was why other rioters started pushing into the building.

He also said he had a gun on him at the time.

“I was soaked to the marrow of my bones. I’ve got .40 with me. “

And according to Reffitt, he’s not the only one.

“The others had weapons. They’re lucky we didn’t shoot them,” he said, seemingly referring to law enforcement trying to keep a violent mob from entering the building. “We could have but we didn’t shoot a single inning.”

Reffitt’s sentencing has been set for June 8 at 10:00 a.m
