almost a month ago, Johnny Depp tried to prove that his ex-wife belongs to amber was the abuser in their relationship by playing on audio recording that she admitted to hitting him. On the tape, Depp can be heard telling her that he tried to leave the room to escape.
“I didn’t fucking do your makeup,” Heard told Depp in the recording. “I fucking hit you.”
On Monday, Heard told a jury that the distinction related to the “differences between Johnny and I in our physical struggles.”
Depp would “proactively hit me and I would have to fall back on hitting him reactively,” Heard said.
“I’m talking about the difference between a punch that Johnny has thrown many times and having to punch him in my defense,” Heard claimed. “I know the difference between these two, and I emphasize the difference between these two, even if he wasn’t twice my size. They are very different.”
Depp sued Heard for defamation in a courtroom in Fairfax County, Virginia, after she opined in the 2018 magazine Washington Post presents herself as a victim of domestic violence. The editorial, which was printed at the height of the #MeToo movement, didn’t mention Depp by name, instead alluding to allegations Heard made when she filed for a restraining order in 2016, about two years earlier.
Heard countered when Depp’s attorney called her allegations a “hoax.”
Depp has cited the recording of Heard admitting to hitting him as evidence the perpetrator-victim relationship was reversed. That Pirates of the Caribbean star supporters turned the popular hashtag on its head with a single letter: #MenToo.
But Heard claims the tape’s context supports her story.
“I was trying to close a door or a bedroom door,” Heard said. “Actually, I was trying to barricade myself behind that door and Johnny was trying to get through the door. He used his body and limbs to try to break through the door while I tried to keep it closed because I knew what he would do to me if he reached me on the other side. And I slapped his arms, his arms, his body as he tried to stop me from closing the door. And that’s a separate incident that we talk about later in the second half of this recording.”
Earlier Monday, Heard testified that Depp punched and choked her on a train in Southeast Asia in August 2015, an alleged incident in which a British judge previously accepted had occurred. Not long after, she said, she ended a brief honeymoon and landed a job on a one-actor television series James Franco.
According to previous statements, Depp was jealous of the younger Franco, who was closer to Heard in age. Depp is now 58 and Heard is 35. Depp once said that Heard described Franco, 44, as “scary” and “raped.”
Without her knowledge or consent, Heard said the show used a “body double” to record a sex scene with Franco, and Depp went into a jealous rage.
“So I have an incredibly jealous husband who’s already mad at me for breaking the rule that I had a sex scene,” Heard said. “Besides, I tell him it wasn’t me. I didn’t film this scene. And you can imagine how upset he was. [He] was angry and, among other things, called me a liar of horror.”
At the time they watched the screener, Heard said the couple had been staying in a chateau in a remote part of France.
“Johnny once slapped me in the face in our bedroom in the castle we were staying in,” she said. “Another moment he punched me in the jaw.”
About a year later, Heard said, she met the billionaire Elon Musk at the 2016 Met Gala.
“He seemed like a real gentleman,” she said, adding that he was seated at a nearby table and the two became friends.
Heard and Musk started dating Depp shortly after their divorce.
Cross-examination has not yet begun, and Heard’s direct examination included several photos of her apparent facial bruises from Depp’s alleged abuse.
