The family of Halyna Hutchins, the cinematographer who was killed on the set of the Rust film in 2021, and Alec Baldwin have reached a secret settlement in the wrongful death lawsuit being filed against the actor and others, according to a statement released by the actor’s attorney became.
The lawsuit, filed in Santa Fe in February against Baldwin, the film’s production companies, its producers and other key members of the crew, alleges numerous violations of industry standards.

Matthew Hutchins, widower of Halyna Hutchins, who was killed on set, will executive produce the film, the statement said.
“We have reached a settlement in our wrongful death case against Rust’s producers, including Alec Baldwin and Rust Movie Productions, LLC, subject to court approval. As part of this settlement, our case is dismissed,” Hutchins said in a statement.
Filming on Rust, which I will now executive produce, will resume in January 2023 with all of the original leads on board. I have no interest in blaming or blaming anyone (on the producers or Mr. Baldwin).
“We all believe that Halyna’s death was a horrible accident. I’m grateful that the producers and entertainment community came together to pay tribute to Halyna’s final work.”
“Throughout this difficult process, everyone has maintained an expressed desire to do what is best for Halyna’s son,” Alec Baldwin’s attorney Luke Nikas of Quinn Emanuel said in a statement.
“We are grateful to everyone who helped resolve this tragic and painful situation.”
Film director Joel Souza, who was also injured in the making of the shoot, is expected to return to the film.
“Those of us lucky enough to have spent time with Halyna knew that she is extremely talented, kind, creative and a source of incredibly positive energy,” he said in a statement.
“I only wish the world would have known her under different circumstances, as I’m sure her amazing work would have done.” In my own attempts to heal, any decision to direct again only made sense to me if it was done with the involvement of Matt and the Hutchins family.
“While certainly bittersweet, I am pleased that together we will now complete what Halyna and I started. All of my effort on this film will be dedicated to honoring Halyna’s legacy and making her proud. It is a privilege to enforce this on their behalf.”
Rust Movie Productions, LLC, through its attorney, Melina Spadone of Pillsbury Winthrop Shaw Pittman, said: “We are pleased that the parties have come together to resolve this matter, which represents an important step forward, subject to court approval Celebrating Halyna’s life and honoring her work.”
The lawsuit also alleged that the production companies and producers had “cut corners” and “decided to hire the cheapest crew available,” specifically that they “knowingly hired a totally unskilled gunsmith” and required her to time in a second role as props assistant master.
Jason Bowles, an attorney for Hannah Gutierrez Reed, who served as a gunsmith on Rust, said they hope the settlement will be recognized as a “measure of justice.”
“Hannah is grateful that this settlement has benefited the Hutchins family and that the parties were able to resolve the civil lawsuit constructively. We hope that the prosecution, too, will recognize that some degree of justice has been achieved in relation to this tragic accident and that they will choose not to press charges,” Bowles said.
Four people, including Alec Baldwin, could still face charges when the final police report on the shooting is released this month, a local prosecutor said in late September.
A spokesman for the Santa Fe District Attorney told CNN in a statement that the settlement agreement will not affect the ongoing criminal investigation into the case.
“While civil lawsuits are settled privately and often involve monetary rewards, criminal cases are all about facts,” Heather Brewer, spokeswoman for the office of the New Mexico First Judicial District Attorney, said in a statement.
“If the facts and evidence warrant a criminal charge under New Mexico law, charges will be filed. Nobody is above the law.”
