A fourth grader faces assault charges after counselor accuses him of groping her during a hug

A fourth-grade Florida student was suspended from school and now faces criminal charges after his school health advisor accused him of inappropriately touching her. The adult claims the 10-year-old grabbed her chest after pretending to hug her – distorting his family’s claims.

On Monday, Oct. 24, a staffer at Holly Hill School in Volusia County said she was groped by a student when she visited his classroom to speak with his teacher.

A police report and suspension letter detailed the act graphically, saying when the counselor “turned sideways to give a side hug,” the little boy put one of his arms around her shoulder and “reached and grabbed her left breast” with his other hand, reports NBC News.

In response, according to a suspension letter issued by the school, which the family’s attorney said she removed his hand from her chest area and asked him to walk away.

A police report says the Holly Hills Police Department was called immediately after the incident, with the counselor claiming he “clasped her left breast in a disrespectful manner” and gave her no choice but to “forcibly remove his hand.” The young person is now threatened with an administrative offense battery charging.

Lawyers hired to represent the interests of the child and his family say he is falsely accused.

According to the lawyers, the school failed to properly investigate the allegations and suspended the boy for ten school days before his return on Tuesday November 8, ignoring that he challenged the counselor’s account. Family members say the story presented is one-sided.

Volusia County Schools declined to comment on the incident.

“My grandson was accused of something and then punished before the facts,” said the child’s grandfather. “We will not accept that.”

USA Today reports that the boy’s grandmother and legal guardian, Lakesha Hollins, also believes the boy did nothing wrong: “We’re talking about a 10-year-old who was kicked out of school because of a possible accident.”

“My grandson said at the hug that she grabbed his hand and held it up and he didn’t really know why she did that,” Hollins continued. “He said she let go of his hand and then he went back to his seat and started talking to other students. They talked about football.”

The identities of both the accuser and the accused are kept secret from the press. The boy’s name will not be released because he is a minor, but the counselor’s name is protected because she invokes Marsy’s law, which allows alleged crime victims in Florida to remain anonymous.

“There are no witnesses [just] her word is against his,” added the grandmother. “He’s only 10.”

No witnesses have been identified, but the fourth-grader’s teacher says in a police report that she was in the classroom during the alleged incident. She also says she didn’t see what the counselor claims.
